Brett Bachman of the Daily Beast shared insight from Knowles Gallant Timmons Partner Chris Timmons, a former Georgia prosecutor, on Kenneth Cheseboro’s effort to have his Georgia RICO case dismissed due to what he alleges are paperwork errors. Timmons explained the effort is a long-shot legal strategy for the lawyer who is accused of aiding Trump’s efforts to overturn the 2020 election through the use of “alternate electors” in several states including Georgia.
“If he was not sworn in, at worst, it’s embarrassing for the Fulton County DA’s office but it would not affect the case,” said Timmons. “The Georgia Supreme Court has held unanimously that the presence of the grand jury of individuals who are not sworn assistant district attorneys will not vitiate an otherwise valid indictment.”
